The central objective of this book is to re-examine the law governing the obligations of the Member States in the European Union. This is carried out from the analytical perspective offered by the interests formulated and pursued by national governments in the EU. Member State in...terests, both as the source and the limitations of the obligations undertaken by national governments in the EU, are interpreted in this book as local, mostly democratically expressed choices, values and other considerations formulated by political communities organised within the framework of States. By choosing Member State interest to frame the analysis of the law, the book expresses a clear intention to explore further the interactions and the potential interconnectedness of the intergovernmentalism of EU decision-making and the normative supranationalism of the application and the enforcement of Member State obligations, in particular at the national level. The book starts by analysing how diversity among the Member States, which arises from different local interests, institutional frameworks and socio-economic arrangements, is assessed and sustained in EU legislation and in the jurisprudence of the Court of Justice. It then examines the impact of EU obligations on Member State territorial authority and territoriality. The book provides a new perspective on Member State interests and European Law by closing the widening gap between the politics and law of European integration and between its political science and legal analysis.

This book draws on the analytic and political dimensions of queer, alongside the analytic and political usefulness of reading emotion, to navigate legal interventions aimed at addressing the rights of LGBT people. Scholars, activists, lawyers, and judges concerned with eliminatin...g violence and discrimination against LGBT people have generated passionate conversations about pursuing law reform to make LGBT injuries, intimacies, and identities visible, while some challenge the ways legal systems marginalise queer minorities. Senthorun Sunil Raj contributes to these ongoing conversations by using emotion as an analytic frame to reflect on the ways case law seeks to progress the intimacies and identities of LGBT people from positions of injury. This book catalogues a range of cases from Australia, United States, and United Kingdom to unpack how emotion shapes the decriminalisation of homosexuality, hate crime interventions, anti-discrimination measures, refugee protection, and marriage equality. While emotional enactments in pro-LGBT jurisprudence enable new forms of recognition and visibility, they can also work, paradoxically, to cover over queer intimacies and identities. Raj shows that reading jurisprudence through emotions can make space in law to affirm, rather than disavow, intimacies and identities that queer conventional ideas about LGBT progress , without having to abandon legal pursuits to better protect LGBT people. This book will be of interest to students and scholars of human rights law, gender and sexuality studies, and socio-legal theory.

This book explores the ways in which minority groups across the world are reshaping the international minority rights protection system. It documents the actions of four major groups that are using transnational social mobilisation to achieve recognition of their identities and t...heir rights. The result is a greater pluralism in global identity politics and a wide range of new group-specific standards that can inform policies on multiculturalism, political participation, and socio-economic inclusion in the national and international spheres. The book begins by summarising the learning from the global movements of indigenous peoples and Roma. The book then focuses in greater depth on the cases of Afro-descendants in Latin America and of Dalits and caste-affected groups in South Asia and beyond. Each case study shows the historical roots of group-specific transnational mobilisation and how activists have constructed a distinct identity frame out of shared experiences. The book explores key parallels and differences between the discourse, framing strategies, organisational structures and political opportunities used in each case to show which factors have influenced the success or failures of their norm entrepreneurship. The role that international institutions have played in supporting these efforts is given special attention, including intergovernmental bodies such as the UN, the EU and the OAS, and international non-governmental organisations. The UN World Conference Against Racism is explored as a particularly significant political opportunity across the cases. Among academic audiences, this book will appeal to those researching minority rights, social movements, global governance, discrimination and multiculturalism from legal, political, sociological and critical theory perspectives. It will also interest practitioners and activists working on minority rights and the challenges of norm compliance, socio-economic inclusion and governance.

This book explores key innovations in Rwandan law, exploring how the homegrown legal system with the civil law and common law legal systems. The author explores the history of Rwandan law through pre-colonial, to colonial and post-independence periods, examines the homegrown lega...l and justice approaches, such as Gacaca, Abunzi and Imihigo, introduced in post genocide Rwanda to deal with legal problems that could not be dealt with using the western legal system; and highlights the innovative Rwandan approach to incorporating international law in the domestic legal system. The book also covers the evolution of the Rwandan Constitutional Law and Constitutionalism since independence; the development of family law from a legal system that oppressed women to one that promotes girls and women rights. Finally, the book explores the contribution of common law in the transformation of the organization, jurisdiction and functioning of Rwandan Courts. This book will be of interest to scholars and students of African law, international law and the legal system in Rwanda.

This book brings together politics, law, financial services regulation, economics and housing policy in the analysis of mortgage lending and macroprudential policy in the UK and US. The book addresses the relationship between housing policy, credit and financial instability in li...ght of the recent global financial crisis, and proposes both short and long-term solutions. Although it is not known where the next crisis will come from, history suggests that it will have credit and property at its source. Thus, it is important that the UK and other countries look more broadly at what should be done in terms of policies, institutions and tools to make the housing market and mortgage lenders more resilient against a future crisis. This book sets out a number of workable proposals. Central to this work are questions relating to the quantitative macroprudential measures, such as loan-to-value (LTV) and debt-to-income (DTI) restrictions, and whether these can be used to any significant extent in western democracies and, if employed, whether they are likely to be effective. In particular, the book questions the political legitimacy of their use and the potential consequences for the institutions, such as central banks, promulgating such policies. Preserving financial stability in very uncertain market conditions is of key importance to central bankers and other regulators, and macroprudential policy is a rapidly growing subject for both legal and economics study. This book will therefore be of interest to financial professionals, policy-makers and academics.

Globalisation has opened new avenues to corruption. Corrupt practices are proliferating not only within national borders but across different countries. Despite many national and international anti-corruption bodies and strategies, corruption far from being eradicated. There is a...n urgent global demand for a better understanding of corruption as a phenomenon and a thorough assessment of the existing regulatory remedies, towards the establishment of more effective (and possibly uniform) anti-corruption measures. Our previous collection Corruption in the Global Era (Routledge, 2019) analysed the causes, the sources and the forms of manifestation of global corruption. An ideal continuation of that volume, this book moves from the analysis of the phenomenon of corruption to that of the regulatory remedies against corruption and for the promotion of integrity. Corruption, Integrity and the Law provides a unique interdisciplinary assessment of the global anti-corruption legal framework. The collection gathers top experts in different fields of both the academic and the professional world - including criminal law, EU law, international law, competition law, corporate law, and ethics. It analyses legal instruments adopted not only at a supranational level but also by different countries, in the attempt of establishing an interdisciplinary and comparative dialogue between theory and practice and between different legal systems towards a better global promotion of integrity. This book will be of value to researchers, academics, and students in the fields of law, criminology, sociology, economics, and ethics, as well as professionals - especially, solicitors, barristers, businessmen and public servants.

Published in 1998. This collection of papers, written by leading lawyers and sociologists in the UK, focuses on the relationships between gender and the law in the context of three areas of law: family law, criminal law and equal rights. The papers argue that gender roles within ...society affect the legal rights of individuals and impact on procedures they go through to enforce their rights or to gain redress for wrongs done to them. By failing to recognize the social and economic situations in which men and women are placed, the law perpetuates inequalities in their positions. Where attempts are made to ensure equality between the sexes, the result is often the exact opposite, because the legal system treats individuals as equals operating in a vacuum, ignoring the argument that equal treatment does not necessarily mean the same treatment, but can mean different treatment to ensure equality of result. Topics include: c Disputes in the area of parental child custody rights c The rights of surviving spouses to their deceased partner's estate c Theories for violent behaviour in women as contrasted with men c Gender bias in criminal sentencing c The role of European law in promoting sex equality in the work place c Pornography and free speech c Homosexuality as a civil right of citizenship
