And justice for all, every legal system on earth guarantees it, but which ones live up to the credo? And why do others fall short of the mark? This title answers these cri...tical questions.

This companion provides scholars and upper level students with a comprehensive and authoritative review of current research and thinking about legal pluralism. Leading global experts come together, each presenting a distinctive aspect of legal pluralism, resulting in a book which... offers a state of the art reference resource. The first part includes broadly theoretical perspectives on legal pluralism and addresses whether legal pluralism is a theory, methodology, a tool of analysis, a descriptive or a normative concept, or a mixture of any of these. This part also includes a specific focus on leading theorists who have made a profound contribution to understanding of the field. The second part includes chapters on distinct legal traditions e.g. Jewish law, Western law, Islamic law, Hindu law, Chinese law, etc. and demonstrates how and to what extent these legal traditions are inherently legally plural and how legal pluralism has any purchase for describing, studying or analyzing them. The third part approaches legal pluralism from various jurisdictional positions, via a series of country studies showing how legal pluralism contributes to a better understanding of the functioning of these legal orders. The authors offer a historical approach and discuss the impact of the reception of foreign laws; the role of legal education; the existence of plural court systems and plural bodies of laws. They also discuss key legal formants introduced through religion, state practices, the presence of tribal and ethnic communities and their practices, and settler colonialism.

Written by distinguished legal and linguistic scholars and practitioners from the EU institutions, the contributions in this volume provide multidisciplinary perspectives on the vital role of language and culture as key forces shaping the dynamics of EU law. The broad spectrum of... topics sheds light on major Europeanization processes at work: the gradual creation of a neutralized EU legal language with uniform concepts, for example, in the DCFR and CESL, and the emergence of a European legal culture. The main focus is on EU multilingual lawmaking, with special emphasis on problems of legal translation and term formation in the multilingual and multicultural European context, including comparative law aspects and an analysis of the advantages and disadvantages of translating from a lingua franca. Of equal importance are issues relating to the multilingual interpretation of EU legislation and case law by the national courts and interpretative techniques of the CJEU, as well as the viability of the autonomy of EU legal concepts and the need for the professionalization of court interpreters Union-wide in response to Directive 2010/64/EU. Offering a good mix of theory and practice, this book is intended for scholars, practitioners and students with a special interest in the legal-linguistic aspects of EU law and their impact on old and new Member States and candidate countries as well.

Environmental crime is one of the most profitable and fastest growing areas of international criminal activity. These types of crime, however, do not always produce an immediate consequence, and the harm may be diffused. As such, the complexity of victimization - in terms of time..., space, impact, and who or what is victimized - is one of the reasons why governments and the enforcement community have trouble in finding suitable and effective responses. This book provides a diverse and provocative array of arguments, critiques and recommendations from leading researchers and scholars in the field of green criminology. The chapters are divided into three main sections: the first part deals with specific characteristics of some of the major types of environmental crime and its perpetrators; the second focuses explicitly on the problem of victimization in cases of environmental crime; and the third addresses the question of how to tackle this problem. Discussing these topics from the point of view of green criminological theory, sociology, law enforcement, community wellbeing, environmental activism and victimology, this book will be of great interest to all those concerned about crime and the environment.

This book is intended to be a comprehensive treatise of Guernsey trust law, providing practical answers for practitioners advising on Guernsey trusts and trustees administering them. In particular, it provides a detailed analysis of the provisions of the Trusts (Guernsey) Law 200...7 (as amended); a consideration of Guernsey trust cases, as well as relevant cases in Jersey and in other jurisdictions; analysis of the legal principles underpinning Guernsey trust law; and where there is no clear Guernsey authority on a particular point of law it gives a reasoned view on the point, drawing on the relevant legal principles, together with a broad assessment of the confidence of which the authors hold that view.

The amicus curiae - or friend of the court - is the main mechanism for actors other than the parties, including civil society actors and States, to participate directly in proceedings in international criminal tribunals. Yet increasing reliance on this mechanism raises a number o...f questions. Are amicus interventions consistent with the inherent structure and purpose of a criminal trial? What impact might they have on the efficiency of trials, fair trial rights and the quality of judicial decision-making? Do amici enhance the representation of different interests in international criminal proceedings? Are amicus submissions actually influencing judicial or other outcomes? Is there a trend towards `non-traditional' uses of the amicus curiae, such as the amicus curiae prosecutor or amici as substitute defence counsel? These questions suggest issues integral to the legitimacy of international criminal trials and institutions, namely: who is able to be represented in proceedings, which actors seek to intervene in trials and why, whether the amicus curiae is an appropriate avenue for certain types of submissions, and what responsibilities might amici hold. This important new book examines the practice of international criminal tribunals and offers suggestions for the role of the amicus curiae before such tribunals.

Rebellious Jurisprudence is the first attempt to construct a theory of judicial dissent as a matter of general international law. Although dissenting and separate opinions are typically associated with the common law tradition, the right of judges to issue such opinions has been ...recognised and reproduced across most international tribunals. Despite this, until now no attempt has been made to theorise the institutionalisation of judicial dissent in international law and its implications for how international tribunals discharge their functions. This study offers a theory of judicial dissent that addresses its ubiquity in international law, notwithstanding the often-fundamental disagreement between the principal legal cultures as to its effects. Rebellious Jurisprudence explores how insights from social anthropology - specifically ritual theory - supplement conventional accounts of judicial dissent. Whereas existing literature focuses upon 'revolutionary' or 'radical' dissent, this study expands our field of focus to sharpen our understanding of the 'everyday' dissent: the (rebellious) 'institutional dissent'. By revealing how judicial dissent operates, and to what ends, Rebellious Jurisprudence is essential reading for those who regularly engage with judicial dissent by international judges - whether judges, practitioners, scholars or students - who seek to deepen their understanding of, and in turn enhance the accuracy and effectiveness by which they engage with, this burgeoning body of jurisprudential activity.

This book seeks to determine to what extent the European Union's efforts to promote its approach to combating trafficking in human beings at the external level contribute to their adoption and implementation outside its borders. It is divided in three parts. The first part aims t...o identify the legal context in which the European Union conducts its externalisation efforts. In the second part, the work done by other actors who are also involved in promoting anti-trafficking activities in the Western Balkans region is analysed, as it also participates to the development of counter-trafficking measures and promote cooperation. The third and final part aims to assess the impact on national legislation and policies of the joint efforts of the European Union and its partners to promote a comprehensive approach to combating trafficking in human beings.
