Public Speaking for Criminal Justice Professionals: A Manner of Speaking is a one-of-a-kind public speaking guide specifically written for criminal justice professionals, written by a criminal justice professional. Author Thomas Mauriello has worked his entire professional career... both as a practitioner and as an educator in the fields of criminal justice and forensic science. This book outlines the public speaking skills he has learned, used, and taught to thousands of criminal justice, forensic science, security, and counterintelligence professionals over the years. The book can either be read from cover-to-cover-to fine tune the reader's existing oral communication skills-or read in a modular, as a reference guide to focus on certain skills and techniques. A list of over 55 proven, effective presentation tools will be listed, discussed, and demonstrated throughout the book-using illustrated criminal justice and forensic sciences topic examples. Contrary to popular believe, simply knowing your subject or being an expert in the subject does not guarantee a successful presentation. Aristotle, who many recognize as the Father of Public Speaking and Forensic Debate, said it best when he declared, It is not enough to know what to say, one must know how to say it. This guide focuses on technique and the recognition that a speaker must have of both the subject and the listener. The purpose is to improve readers' skill level and ability to engage and, thereby, inform the listener. Whether preparing to speak to one person, or one thousand people, Public Speaking for Criminal Justice Professionals provides specific techniques for professionals to speaking with confidence, and present effective engaging presentations.

In the wake of the Charlie Gard and Alfie Evans cases, a wide-ranging international conversation was started regarding alternative thresholds for intervention and the different balances that can be made in weighing up the rights and interests of the child, the parent's rights and... responsibilities and the role of medical professionals and the courts. This collection provides a comparative perspective on these issues by bringing together analysis from a range of jurisdictions across Europe, North and South America, Africa and Asia. By contextualising the differences and similarities and by drawing out the cultural and social values that inform the approach in different countries, this volume is therefore highly valuable to scholars across jurisdictions to inform their own local debate on how best to navigate such cases, but also to foster inter-jurisdictional debate on the issues. The book brings together commentators from the fields of law, medical ethics, and clinical medicine across the world, actively drawing on the view from the clinic as well as philosophical, legal and sociological perspectives on the crucial question of who should decide about the fate of a child suffering from a serious illness. In doing so, the collection offers comprehensive treatment of the key questions around whether the current best interests approach is still appropriate, and if not, what the alternatives are. It engages head on with the concerns seen in both the academic and popular literature that there is a need to reconsider the orthodoxy in this area.

This book offers a (re-)assessment of the balance between executive and legislative powers at both national and European levels taking all these recent changes into account. It asks whether parliaments were truly empowered with the implementation of the Lisbon Treaty or whether t...his change was in reality much curtailed in the wake of the Eurocrisis and other recent challenges. It brings together lawyers and political scientists to provide a multidisciplinary and multi-level analysis. It firstly examines the imbalance that exists between executive and legislative powers in a multilevel perspective and considers issues such as strategies to recalibrate executive-legislative relations. Secondly, it considers Member States, from an individual and comparative perspective. Finally, it explores the executive-legislative relations in those policy areas which are particularly sensitive to governments, such as trade policies, economic governance, and justice.

Few have as close an eye-witness view of the evolution of European Union law as judges at the ECJ. They not only observe, however, but actively work towards its development. This collection assesses the momentous contribution to European Union law made by Jose Luis da Cruz Vilaca.... Taking those areas of law which were directly shaped by his judgments (institutional law/internal market/free movement of persons and judicial review), leading scholars assess his legacy. Through this prism, the story of EU law can be charted.

Firm Dominance in EU Competition Law: The Competitive Process and the Origins of Market Power

How does it come about that a certain firm dominates a market? Can an understanding of this process lead to a more effective enforcement of competition law? That is the question approached in this compelling book. The author reviews the European Union's (EU's) Article 102 case la...w, comparing it with United States (US) provisions, demonstrating that new ways of looking at market power are needed - today's tech giants differ from older monopolies. He clarifies the role of dominant firms in the competitive process, proposing that conduct should be scrutinized differently depending on the source of market power, rather than using the same approach for all dominant undertakings. Supporting his contention that the legal consequences that derive from holding a dominant position cannot be disassociated from the sources of that market power-that a dynamic understanding of dominance requires looking both forwards and backwards in time-the author examines such sources of dominance as the following: - statutory dominance derived from explicit protectionist measures or subtler geoeconomic strategies; - legacy firms such as the telecommunications or transport industries; - natural monopolies, e.g., the exploitation of a mine; - investment efforts undertaken in a competitive environment; - intangible resources such as timing, reputation, experience, innovation capabilities, or managerial processes; - lucky monopolies; and - anticompetitive behavior on the road to dominance. Drawing insights from EU and US case law, industrial organization scholarship, and strategic management literature, the book resolves questions related to the role that the origins of market power have played and should play in the enforcement of EU competition rules against dominant firms. It concludes with a list of policy recommendations bringing the application of Article 102 TFEU against dominant firms more in line with the objective of protecting the competitive process. With its focus on how EU competiti

This book provides a detailed study of the role of the judiciary in environmental law. It examines theoretical issues concerning the role of judges in such decision-making, taking account of different legal cultures and contexts, exploring the multifaceted pressures which rest on... the shoulders of courts when navigating the tensions between maintaining neutrality, resolving disputes, and providing guidance and assistance for future courts, policy-makers and decision-makers. In addition, it explores the particular challenges which arise in an environmental context, before articulating the range of environmental dispute 'models' which can and do exist in the context of the environmental law of England and Wales. The second part of the book looks at the consequences of these findings, and explores the relationship between adjudication and coherence before concluding with an exploration of what constitutes good environmental adjudication.
