This book addresses the relationship between International Refugee Law and International Human Rights Law. Using international refugee law's analytical turn to human rights as its object of inquiry, it represents a critical intervention into the revisionism that has led to concep...tual fragmentation and restrictive practices. Mainstream literature in refugee law reflects a mood of celebration, a narrative of progress which praises the discipline's rescue from obsolescence. This is commonly ascribed to its repositioning alongside human rights law, its veritable rediscovery as an arm of this far greater edifice. By using human rights logic to construct the current legal paradigm and inform us of who qualifies as a refugee, this purportedly lent areas of conceptual uncertainty a set of objective, modern criteria and increased enfranchisement to new, non-traditional claimants. The present work challenges this dominant position by finding the untold limits of its current paradigm. It stands alone in this orientation and hereby represents one of the most comprehensive, heterodox and structurally-detailed reviews of this connection. The exploration of the gap between modern approaches and the unsatisfactory realities of seeking asylum forms the substance of this book. It asserts, by contrast, the existence of revolution rather than evolution. Human rights law has erased the founding tenets of the Refugee Convention, enabling powerful states to contain refugees in their region of origin. The book will be essential reading for those interested in Refugee Law, Refugee Studies, Postcolonial Legal Studies, Postmodern Critiques and Critical Legal Theory. Additionally, given its relevance for the adjudication of refugee claims, it will be an important resource for solicitors, barristers and judges.

            Sex-Positive Criminology

Sex-Positive Criminology proposes a new way to think about sexuality in the fields of criminology and criminal justice. Sex-positivity is framed as a humanizing approach to sexuality that supports the well-being of self and others. It is rooted in the principle of active and ongo...ing consent, and it encourages perspectives that value bodily autonomy, the right to access education, and respect for sexual difference. In this book, the authors argue that institutions such as prisons, schools, and healthcare facilities, as well as agents of governments, such as law enforcement, correctional officers, and politicians, can unduly cause harm and perpetuate stigma through the regulation and criminalization of sexuality. In order to critique institutions that criminalize and regulate sexuality, the authors of Sex-Positive Criminology examine case studies exploring the criminalization of commercial sex and related harm (at the hands of law enforcement) experienced by those who sell sex. They investigate sex education in schools, reproductive justice in communities and institutions, and restrictions on sexuality in places like prisons, jails, juvenile detention, and immigrant detention facilities. They look into the criminalization of BDSM practices, and address concerns about young people's sexuality connected to age of consent and privacy violations. The authors demonstrate how a sex-positive perspective could help criminologists, policymakers, and educators understand not only how to move away from sex-negative frameworks in theory, policy, and practice, but how sex-positive criminological frameworks can be a useful tool to reduce harm and increase personal agency. Written in a clear and direct style, this book will appeal to students and scholars in criminology, sociology, sexuality studies, cultural studies, criminal justice, social theory, and all those interested in the relationship between sexuality and the crimino-legal system.

Traditionally, human rights have protected those facing the sharp edge of the criminal justice system. But over time human rights law has become increasingly infused with duties to mobilise criminal law towards protection and redress for violation of rights. These developments gi...ve rise to a whole host of questions concerning the precise parameters of coercive human rights, the rationale(s) that underpin them, and their effects and implications for victims, perpetrators, domestic legal systems, and for the theory and practice of human rights and criminal justice. This collection addresses these questions with a focus on the rich jurisprudence of the European Court of Human Rights. The collection explores four interlocking themes surrounding the issue of coercive human rights: (1) Key threads in the doctrine of the European Court of Human Rights on duties to mobilise the criminal law as a means of delivering human rights protection. (2) Factors that contribute to a readiness to demand coercive measures, including discrimination and vulnerability, and other key justificatory reasoning shaping the development of coercive human rights. (3) The most pressing challenges for the ECtHR's coercive duties doctrine, including: - how it relates to theories and rationales of criminalisation and criminal punishment; - its implications for the fundamental tenets of human rights law itself; - its relationship to transitional justice objectives; and - how (far) it coheres with the imperative of effective protection for persons in precarious or vulnerable situations. (4) The (prospective) evolution of coercive human rights doctrine and its application within national jurisdictions.

This ground-breaking book offers an extensive legal analysis-grounded in public law, EU, and international law-of arms trade regulation, integrated with insights drawn from international relations. The sale of weapons and related technologies is, globally, one of the most politic...ally controversial and ethically contentious forms of commerce. Intimately connected with sustaining repressive governments and violations of international human rights and humanitarian law, arms exports are also a central element in the economic and strategic policies of the governments of all large industrial states. They have also been the source of abundant corruption, and of serious challenges to the norms and effectiveness of constitutional accountability in democratic states. On paper, the arms trade is heavily regulated: national legislation and international treaties are in place which purport to prohibit certain transactions and limit others. Yet despite its importance, legal and international relations scholarship on the subject has been surprisingly limited. This book fills this gap in the literature by examining and comparing the export control regimes of eight leading nations - the USA, Russia, the UK, France, Germany, Sweden, China, and India - with chapters contributed by leading experts in the field of law and international relations.

Carefully, co-ordinated to ensure breadth, relevance and lack of overlap, the topics covered are addressed by authors are the very top of their profession, whether in legal practice or acad...emia, and are presented in a manner which is topical and clear. Part I offers a detailed and critical analysis of issues of contemporary importance concerning new liability regimes and developments. Part 2 discusses how parties, in particular ship operators, attempt in contemporary practice to allocate their risks concerning ship operations. Part 3 evaluates the legal position of those involved in more 'back office' operations. The book provides an invaluable guide to recent legal and practical developments and offers a comprehensive, well-informed and thoroughly practical guide on what is a very complex and developing area of law. It will therefore be of great use to legal practitioners and administrators of ship operations worldwide, as well as students in this area and academics associated with maritime law generally.

This book provides in-depth comparative analysis of how religious penal clauses have been developed and employed within Asian common law states, and the impact of such developments on constitutional rights. By examining the theoretical and conceptual underpinnings of religious of...fences as well as interrogating the nature and impact of religious penal clauses within the region, it contributes to the broader dialogue in relation to religious penal clauses globally, whether in countries which practice forms of secular or religious constitutionalism. Asian practice is significant in this respect, given the centrality of religion to social life and indeed, in some jurisdictions, to constitutional or national identity. Providing rigorous studies of common law jurisdictions that have adopted similar provisions in their penal code, the contributors provide an original examination and analysis of the use and development of these religious offence clauses in their respective jurisdictions. They draw upon their insights into the background sociopolitical and constitutional contexts to consider how the inter-relationship of religion and state may determine the rationale and scope of religious offences. These country chapters inform the conceptual examination of religious views and sentiments as a basis for criminality and the forms of 'harm' that attract legal safeguards. Several chapters examine these questions from a historical and comparative perspective, considering the underlying bases, scope, as well as evolving objectives of these provisions. Through these examinations, the book critically interrogates the legacy of colonialism on the criminal law and constitutional practice of various Asian states.

From Babylon to the Silicon Valley-The Origins and Evolution of Intellectual Property A Sourcebook Nuno Pires de Carvalho At its core, intellectual property today is the same as it was six thousand years ago: an instrument for the assertion of the identities of merchants and manu...facturers in their struggle to lure customers with honesty and fairness. It arises spontaneously whenever and wherever entrepreneurs carry out their professions in an environment of competition. This masterful book, the first of its kind, presents more than two hundred sources going back to ancient Egypt, sharply detailing the evolution of intellectual property right up to its current prominence in global trade and international law. Highlighting important moments in the evolution of the intellectual property, the author-one of the world's best known authorities in the field-assembles his chosen sources in a way that sheds definitive light on such aspects as the following: early origins in the appropriation of differentiating assets by merchants and manufacturers; evolution of trademark law up to the adoption of the TRIPS Agreement; evolution of patent law, demonstrating in detail how English and U.S. courts moulded its modern interpretation; differentiation of industrial designs; the comparatively modern development of trade secrets law; origins and evolution of international protection through treaties and free trade agreements; and the prodigious expansion of intellectual property law in the past few decades to previously unprotected areas of business and professional activity. The sources-many translated into English for the first time-are preceded when appropriate by brief notes explaining their context and relevance. The book closes with a chapter on contemporary debates, such as new areas of protection and new social controversies. As a compilation of sources that would be otherwise unavailable to most readers, this factual and impartial account of why and how intellectual property ha
