            This monograph explores the optimal way to promote compatibility and to address cross-border problems between systems of proprietary security rights over tangible movables and receivables in Europe. Current cross-border problems mainly concern enforceability of proprietary securi...ty rights against third parties, including a security-provider debtor's other creditors on insolvency. Drawing on comparative analysis, it gives an answer to how these cross-border problems can best be solved and combines both substantive law and private international law (and their interaction). It gives a full view of the academic literature of more recent years that has appeared in English, German, Dutch and the Scandinavian languages. The concrete means through which compatibility can be promoted are organised into four main approaches: these are a centralised substantive approach, which can be introduced at EU level, and three 'gentler approaches' at Member State level, namely a centralised conflicts-approach, a local conflicts-approach and a local substantive approach. This book makes the important point that a single model of a system of security rights will not be the answer, and suggests instead an integrated approach envisaging a division of labour between the four approaches. To guide such division of labour, the study proposes a set of objectives with a view to capturing the essence of what can be regarded as desirable development towards greater compatibility. This book is an important contribution to the debate on harmonisation of secured transactions law in Europe, and more widely. It will be extremely valuable for all academics and legal practitioners who are interested in this field.
