            This book examines the outcomes of a five-year ethnographic study of two North of England police forces; the prism through which to revisit the question of the regulation and legitimacy of police powers. Central to this study is the degree to which discretion still plays a centra...l role in the exercise of these powers. It shows how this reliance on discretionary powers is fraught with difficulty. The authors demonstrate that in order to effectively reform the exercise of these powers, the police service should be regarded as having a unique culture, where change and uncertainly are commonplace. It is only by recognising the unusual working practises of policing, can meaningful reform be achieved; making this book required reading for policy makers in the field of criminal justice.

This book considers a range of different approaches to, and ideas about the nature of tax justice a...nd covers areas such as: - imbalances in international tax arrangements that deprive developing countries of revenues from natural resources and allow wealthy taxpayers to use tax havens; - protests against governments and large business; - attempts to influence policy through more technical means such as the OECD's Base Erosion and Profits Shifting project; - interpersonal matters, such as the ways in which tax systems disadvantage women and minorities; - the application of wider philosophical or economic theories to tax systems.             Traditionally, human rights have protected those facing the sharp edge of the criminal justice system. But over time human rights law has become increasingly infused with duties to mobilise criminal law towards protection and redress for violation of rights. These developments gi...ve rise to a whole host of questions concerning the precise parameters of coercive human rights, the rationale(s) that underpin them, and their effects and implications for victims, perpetrators, domestic legal systems, and for the theory and practice of human rights and criminal justice. This collection addresses these questions with a focus on the rich jurisprudence of the European Court of Human Rights. The collection explores four interlocking themes surrounding the issue of coercive human rights: (1) Key threads in the doctrine of the European Court of Human Rights on duties to mobilise the criminal law as a means of delivering human rights protection. (2) Factors that contribute to a readiness to demand coercive measures, including discrimination and vulnerability, and other key justificatory reasoning shaping the development of coercive human rights.             This original study takes its cue from theoretical and ideological calls to challenge globalisation as a dynamic whose forces of homogenisation - and resistance - are led from, and directed against, a diffuse conception of the Global North. The book asks: what can we see when we ...shift the lens from known and usual understandings of legal globalisation towards lesser understood and apparently invisible processes? And moreover, how can we go beyond a North-South binary to understand legal change? The study of law and globalisation has developed into a mature field over the past twenty years, with a variety of empirically grounded theoretical understandings of (trans)national legal fields and orderings. Yet, despite the dynamics of legal pluralism and the ripple effects of legal transplants and transformations, there have been pushes and shoves against the globalising ambitions of these theoretical canvasses. The ongoing surge of populism in Europe and the United States is challenging the policies and institutions of what we even think of as the global and the prominence taken by China is questioning the position of the United States as an unrivalled hegemon in global political, economic, social and legal diffusion processes. Through empirical studies that focus on frontier-zones of legal globalisation in a variety of postcolonial sites including India, Pakistan and Latin America, the book suggests a process of de-centering through reflexivity on the individual and structural variables that account for individual trajectories within the field. Dafur ist diese Modell zunachst darzustellen, wobei der Schwerpunkt auf Jakobs' Abgrenzung von Feind und Burger liegen wird. In einem zweiten Schritt ist das Modell des Feindstrafrechts dann einer Kritik zu unterziehen. Hierbei soll wiederum der Begriff des Feindes im Vordergrund stehen. Ausserdem wird in diesem Rahmen danach zu fragen sein, ob Jakobs' Thesen als blosse Beschreibung der 'wirklichen' Rechtslage oder doch als 'normatives Programm' aufzufassen sind, da im Schrifttum die Kritik unter der einen Pramisse gravierend von derjenigen unter der anderen abweicht. Eines der wichtigsten Mittel, die dem Staat zur Bekampfung terroristischer Bedrohungen zur Verfugung stehen, ist das Strafrecht, das gemeinhin als sein scharfstes Schwert gilt. Als Jurist kann man sich jedoch fragen, ob das geltende (deutsche) Strafrecht uberhaupt auf derartige Kriminalitat ausgelegt ist und hierauf angemessen reagieren kann oder ob es dafur nicht eine ganz andere als seine herkoemmliche, 'uberlieferte' Gestalt annehmen musste oder ob es eine solche andere Gestalt bereits angenommen hat. Von den unterschiedlichen Antworten, die auf diese Frage gegeben worden sind, ist das vor allem im ersten Jahrzehnt unseres Jahrhunderts diskutierte und stets mit dem Namen Gunther Jakobs verbundene Modell des Feindstrafrechts zu gewisser Bekanntheit gelangt.
