The legal aspects of New Zealand's defence and security are too easily taken for granted. A cursory review of this country's history reveals, however, that protecting this nation from threats to its security has had a significant impact on New Zealand and on its people from the e...arliest times until now. The law now impinges every aspect of this important subject, both at the domestic and international level.

Philip Joseph's Constitutional and Administrative Law in New Zealand is one of the most recognised legal treatise titles in New Zealand. Now entering its fifth edition, this perennial text has been modernised with the new title Joseph on Constitutional and Administrative Law. The... new edition builds on the strengths of earlier editions, coupling historical and contemporary analyses of public law principles, while also including a new exploratory chapter on Tikanga Maori and the law. This new edition continues the high scholarly standards that distinguished the earlier editions. It represents a thorough and comprehensive revision of constitutional and administrative law developments since the previous edition published in 2014. It interrogates contemporary developments, while retaining the scholarly account of the doctrinal foundations of public law that is a defining feature of the text. A key development with the fifth edition is the new chapter that records increasing integration of tikanga Maori in legislative and judicial developments. The author interprets these developments as comprising a new form of legal pluralism that signals a distinctively indigenous, New Zealand jurisprudence. The author, Philip A Joseph, is an acknowledged authority on New Zealand constitutional and administrative law.

The award winning Volume One of this series, published in 2013, contained a selection of full decisions of the Court from 1862-1887. This volume takes the story of the Native Land Court forward to 1909 and the great consolidating Native Land Act of that year. The period from 1888...-1909 was a very important, and somewhat neglected, one in the history of the Native Land Court and its allied institutions. This book is not merely a compilation but a definitive study of the Native Land Court in its political and legal context.

Youth Justice in New Zealand critiques law, theory and practice in the New Zealand youth justice system. Reflecting on the unique challenges of children and youth, it analyses the principles, legislation and policies governing the operation of the youth justice system including p...ractice and procedure in the distinctive Youth Court jurisdiction. This third edition discusses developments since the second edition was published in 2016. It brings the text up-to-date with the youth justice age being raised to 18 for most offences; the new operating model and Ministry for Children/Oranga Tamariki, and the updated theoretical framework of the legislation. Case law and wider analysis have been updated throughout each chapter. An entirely new chapter considers the place of children and young persons in the adult criminal justice system. Youth Justice in New Zealand (3rd edition) is the essential black letter law research and reference point for youth advocates, practitioners, academics, and members of the judiciary.

This is the third volume in a series of books dealing with the Native/Maori Land Court (established 1862-1865 and which is still operative and is an important part of the New Zealand legal system). The earlier volumes were published in 2013 and 2015 and covered the history of the... court from its establishment until 1909. Volume 3 covers the history of the Court in the 20th century, from 1909-1953. Like its predecessors, this book is both a historical work and a compilation of the Court's principal judgments. The introductory part of the book is a historical narrative, which explores the historical evolution of Maori land law in its historical and international context. The remaining part of the book is a comprehensive collection of leading judgments of the Native/Maori Land Court and of its appellate body, the Native/Maori Appellate Court. Each judgment is preceded by a full casenote which explains the case, its context, and its legal and historical importance. The period covered by this book saw many significant new developments in the field of Maori land law. These new developments included the Maori land development programme pioneered by Sir Apirana Turupa Ngata and many changes to the law relating to the succession (whether by will or intestacy) of interests in Maori freehold land. Also important were changes relating to Maori legal interests in the foreshore and seabed, river beds, and lakes. These changes are reflected in the cases that have been selected for inclusion in this volume. These decisions include the decisions relating to Lake Waikaremoana, Lake Omapere, and the Whanganui River. The volume also collects together numerous decisions relating to wills and intestacies, reflecting the importance of this part of the Court's jurisdiction in the twentieth century. As with earlier volumes, cases have been selected for inclusion both because they are legally and historically important but because they illustrate the practical workings of the Court and
